 Judicial organisation of the Kingdom

According to article 82 of the Constitution, the Judiciary shall be independent from the Legislative and Executive powers. Sentences shall be passed and executed in the King's name (Article 83). Upon recommendations made by the Supreme Council of Magistracy, Magistrates shall be appointed by Royal Decrees (Article 84). Magistrates in the bench shall be irremovable (Article 85).

The Supreme Council of Magistracy shall be presided over by the King. It shall further consist of:

- the Minister of Justice as Vice-President;

- the First President of the Supreme Court; the Prosecutor General in the Supreme Court;  the President of the First Chamber the Supreme Court;

- two representatives elected among magistrates of the Court of Appeal;

- four representatives elected among magistrates of first degree courts.(Article 86).

The Supreme Council of Magistracy shall ensure the implementation of the guarantees granted to magistrates regarding their promotion and discipline (Article 87).

The judicial organisation

Article one of the 1-74-388 Decree issued on Joumada II 24, 1394 (July 15, 1974) determines the judicial organisation of the Kingdom as follows:

*Common law jurisdictions are composed of:

- Supreme Court.

- Courts of Appeal

- First Instance Tribunals

- Communal and District Courts

 

*specialised jurisdictions:

- Administrative Tribunals

- Tribunals of Commerce.
