 Judicial organisation of the Kingdom

The judicial organisation concerns all the tribunals and courts of the Kingdom. The term “tribunal” indicates inferior courts such as the court of first instance. The term “court” refers to superior courts like the courts of appeal or the Supreme Court.

According to Article 82 of the Kingdom’s Constitution, the judicial authority shall be independent from the legislative power and the executive power. Article one of

The 1-74-388 Decree issued on Joumada II 24, 1394 (July 15, 1974) determines the judicial organisation of the Kingdom. It comprises common law jurisdictions, specialised jurisdictions, and exceptional jurisdictions.

Common law jurisdictions are composed of:

837 Communal and District Courts ;
68 First Instance Tribunals including 183 centre for resident judges ;

21 Courts of Appeal;

The Supreme Court.

The specialised jurisdictions are:

7 Administrative Tribunals;

8 Tribunals of Commerce;

3 Appellate Courts of Commerce;

The High Court (article 88 of the Constitution).
The Permanent Tribunal of the Royal Armed Forces:

Until 1965, French had been the working language of Moroccan jurisdictions. Since then, Arabic has been used instead with the exception of the acts registered in the trade registers which are still accepted in French.
