Elecciones legislativas de 2026: la operación electoral tuvo lugar en condiciones normales (Presidencia del Ministerio Público)

Mourad El Alami, head of the Public Action, Monitoring of the Implementation of Criminal Policy and Analysis of Criminal Phenomena Division at the Presidency of the Public Prosecution, said Friday that the September 23, 2026 elections took place normally and under good conditions, noting that the number of complaints registered on the occasion of this election (403 complaints) decreased compared with the number recorded during the 2021 elections (1,071 complaints).

El Alami noted that, pursuant to their constitutional powers, Public Prosecution Offices received 403 complaints, some of which were filed directly with the Public Prosecution Offices, while others were submitted electronically through the digital applications set up by the Presidency of the Public Prosecution for citizens, enabling them to file their complaints remotely.

He also noted that election day saw the highest number of complaints being registered.

El Alami further said that the judicial investigations conducted in this regard were carried out with precision and efficiency, as well as with the necessary promptness required at this stage, with the average time taken to complete the investigations not exceeding 48 hours.

An analysis of the nature of electoral offenses recorded at the level of Public Prosecution Offices shows that most concerned ordinary crimes habitually committed during electoral campaigns, such as acts of violence, exchanges of abusive and insulting language, as well as violations of privacy, he stressed.

El Alami also highlighted an increase in the number of crimes committed through electronic means, namely social media, noting that several complaints registered in this regard concerned defamation or violations of privacy. Judicial investigations were opened in this regard and legal proceedings were initiated against the offenders, he said.

Regarding cases involving the failure to hand over copies of the minutes to candidates’ delegates, these remained limited both in number and geographically. He added that four complaints were registered, distributed among the local electoral constituencies of Guelmim, Fahs-Anjra and Souk El Arbaa du Gharb. Judicial investigations were subsequently opened and the necessary legal measures taken: two complaints were dismissed for lack of evidence of the criminal act, while the other two are still under investigation.

El Alami also recalled that the Organic Law on the House of Representatives precisely defines, through Article 57, the procedure for obtaining copies of these minutes, whereby the presidents of polling stations hand over these copies to the delegates of candidates present when the minutes are drawn up.

In this regard, he said that the offense related to the failure to hand over the voting minutes requires a specific condition: the presence of the candidate’s delegate inside the polling station at the time the minutes are drawn up. He added that if this person leaves the polling station and subsequently returns after the completion of the counting process and the drawing up of the voting minutes, the legal elements constituting the offense are not met and, consequently, judicial proceedings cannot be initiated in this regard, due to the absence of this fundamental legal condition.

The September 23 election was subject to direct monitoring by the Public Prosecution Offices, through close monitoring of the various stages of this electoral process, strict application of the law, and a commitment to ensuring that the elections took place under sound conditions, with the legal rules governing this process duly respected.
